Data Processing Addendum

This Data Processing Addendum ("DPA") forms part of the agreement between YourSaleMate ("Processor", "we"), based in Pakistan, and the customer ("Controller", "you") that uses our service. It governs how we process personal data on your behalf. Where this DPA conflicts with the Terms of Service, this DPA controls for data protection matters.

1. Roles

For personal data contained in the content you connect and the conversations your agent handles, you are the Controller and we are the Processor. You are responsible for having a lawful basis to collect that data and to have us process it.

2. Scope and details of processing

  • Subject matter: providing the YourSaleMate service.
  • Nature and purpose: hosting your content, generating agent responses, capturing leads, booking meetings, and improving the service.
  • Duration: for as long as your account is active, plus any period required by law.
  • Categories of data subjects: your website visitors and end users.
  • Categories of personal data: identifiers and contact details (such as name, email, phone), conversation content, and usage data.

3. Our obligations

  • Process personal data only on your documented instructions, including this DPA.
  • Ensure personnel who access personal data are bound by confidentiality.
  • Implement appropriate technical and organizational security measures (Section 6).
  • Assist you, so far as reasonably possible, with data subject requests.
  • Make available information reasonably necessary to demonstrate compliance.

4. Sub-processors

You authorize us to engage third-party service providers (sub-processors) to help deliver the service. We impose data protection terms on each that are no less protective than this DPA, and we remain responsible for their performance. A current list of sub-processors is available on request at support@yoursalemate.com, and we will inform you before engaging a new one where required.

5. Use of data to improve and train our AI

We use customer content and conversation data to operate, improve, and train the AI systems that power the service. We handle this data under the confidentiality and security commitments in this DPA. If you do not want your data used to train our models, contact us at support@yoursalemate.com to discuss available options.

6. Security

We maintain reasonable technical and organizational measures designed to protect personal data against unauthorized access, loss, or disclosure, including encryption in transit, access controls, and least-privilege practices. No system is completely secure, but we work to keep your data safe.

7. Personal data breaches

We will notify you without undue delay after becoming aware of a personal data breach affecting your data, with the information reasonably available to help you meet your own notification obligations.

8. International transfers

We and our sub-processors may process data in countries other than yours, including Pakistan and the United States. Where required, such transfers are made under an appropriate safeguard, such as Standard Contractual Clauses. [Confirm the specific transfer mechanism with counsel.]

9. Data subject rights

Taking into account the nature of the processing, we will assist you with appropriate measures to help you respond to requests from data subjects to exercise their rights.

10. Return and deletion

On termination of your account, we will delete or return your personal data within a reasonable period, unless we are required by law to retain it.
